1. Acceptance of Terms

By downloading, installing, or using SpeaksyAI (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and SpeaksyAI.

You must be at least 13 years old (or 16 in the EU) to use SpeaksyAI. By using the App, you confirm that you meet this age requirement.

2. Description of Service

SpeaksyAI is an AI-powered language learning platform that provides:

  • •Real-time AI voice tutoring sessions powered by Google Gemini 2.5 Flash
  • •Structured language courses across 54+ supported languages
  • •Interactive language learning games and quizzes
  • •AI-powered pronunciation evaluation and feedback
  • •Gamification features including XP, streaks, and achievements
  • •Progress tracking and learning analytics
  • •Expert mode sessions for advanced learners
  • •Subscription-based premium access to advanced features

3. User Accounts

3.1 Account Registration

  • •You must create an account to use SpeaksyAI, via email/password or OAuth (Google or Apple sign-in)
  • •You are responsible for maintaining the confidentiality of your login credentials
  • •You must provide accurate, current, and complete information during registration
  • •You are responsible for all activities that occur under your account
  • •You must notify us immediately at contact@speaksyai.com of any unauthorized use of your account

3.2 Account Restrictions

  • •You may only create one account per person
  • •Accounts are personal and non-transferable
  • •You may not share your account with others or allow others to access your account
  • •We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscriptions & Payments

4.1 Free Tier

  • •SpeaksyAI offers limited free access to basic features
  • •Free tier usage is subject to session limits and feature restrictions

4.2 Premium Subscriptions

  • •Premium plans are available as monthly or annual subscriptions
  • •Subscriptions are processed via Apple In-App Purchase (iOS), Google Play Billing (Android), or Razorpay (direct)
  • •All prices are displayed in your local currency and include applicable taxes
  • •Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date

4.3 Cancellation & Refunds

  • •You may cancel your subscription at any time through the App or your device's subscription management settings
  • •Cancellation takes effect at the end of the current billing period
  • •Refund eligibility is governed by Apple App Store, Google Play Store, or Razorpay refund policies
  • •We do not offer pro-rated refunds for unused subscription periods unless required by law

4.4 Price Changes

  • •We reserve the right to change subscription prices with at least 30 days' notice
  • •Continued use after a price change constitutes acceptance of the new pricing

5. Microphone & Audio Permissions

SpeaksyAI requires access to your device's microphone to deliver its core AI voice tutoring service. By using voice features:

  • •You grant SpeaksyAI permission to record audio during active voice sessions
  • •Audio is processed in real-time by Google Gemini AI for language tutoring
  • •Voice sessions may be recorded and stored per our Privacy Policy
  • •You can revoke microphone permission in your device settings at any time, but this will prevent use of voice features
  • •Do not record private conversations of others without their consent

6. Acceptable Use

You agree NOT to use SpeaksyAI to:

  • •Violate any applicable laws or regulations
  • •Upload, transmit, or share harmful, illegal, or offensive content during voice sessions
  • •Attempt to reverse-engineer, decompile, or extract the App's source code
  • •Circumvent any security features or access controls
  • •Use automated scripts, bots, or scrapers to interact with the App
  • •Create multiple accounts to abuse free tier limits
  • •Infringe on intellectual property rights of SpeaksyAI or third parties
  • •Impersonate other users or SpeaksyAI staff
  • •Attempt to disrupt or interfere with the App's servers or services

7. Intellectual Property

7.1 SpeaksyAI Content

  • •The App, its content, features, and functionality are owned by SpeaksyAI and protected by copyright, trademark, and other intellectual property laws
  • •Course content, AI models, and learning materials are proprietary to SpeaksyAI
  • •You may not copy, reproduce, distribute, or create derivative works from our content without written permission

7.2 User Content

  • •Voice recordings and other content you create during sessions remain your property
  • •You grant SpeaksyAI a limited, non-exclusive, revocable license to process your voice data solely to: (a) deliver the AI tutoring service in real-time, and (b) improve AI accuracy using anonymized, non-identifiable aggregates — never your identified recordings without separate explicit consent
  • •This license is scoped to the duration of your account and terminates immediately upon account deletion
  • •We will never use your identifiable voice recordings to train third-party AI models without your explicit opt-in consent
  • •To revoke this license: delete your voice recordings in Profile > Settings, then delete your account

8. Third-Party Services

SpeaksyAI integrates with the following third-party services. Your use of these services is governed by their respective terms:

  • •Google Gemini API — Google Terms of Service & Privacy Policy
  • •Google Sign-In — Google Terms of Service
  • •Sign in with Apple — Apple Developer Program License Agreement
  • •Google Play Billing — Google Play Developer Distribution Agreement
  • •Apple In-App Purchase — Apple Media Services Terms and Conditions
  • •Razorpay — Razorpay Terms of Use
  • •Firebase — Google Firebase Terms of Service
  • •Google Analytics 4 — Google Analytics Terms of Service & Privacy Policy
  • •Firebase Analytics — Google Firebase Terms of Service

We are not responsible for the privacy practices or content of third-party services.

9. Disclaimers & Limitations of Liability

9.1 No Guarantee of Results

  • •SpeaksyAI does not guarantee fluency, proficiency, or any specific language learning outcomes
  • •AI tutoring is for educational assistance only and does not replace professional language instruction

9.2 Service Availability

  • •We strive for high availability but do not guarantee uninterrupted service
  • •Voice sessions depend on internet connectivity; quality may vary based on network conditions
  • •We reserve the right to modify, suspend, or discontinue features with reasonable notice

9.3 Limitation of Liability

  • •To the maximum extent permitted by law, SpeaksyAI's total liability shall not exceed the amount you paid us in the 12 months preceding the claim
  • •We are not liable for indirect, incidental, consequential, or punitive damages
  • •Some jurisdictions do not allow these limitations — in such cases, our liability is limited to the maximum extent permitted

10. Termination

We may terminate or suspend your account and access to SpeaksyAI at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, SpeaksyAI, or third parties.

You may terminate your account at any time through the Profile > Settings > Delete Account option. Upon termination, your right to use the App ceases immediately. Data deletion follows the retention schedule in our Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be attempted through mutual negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 of India.

California users: Notwithstanding the above, users in California retain the right to bring individual claims under the California Consumer Privacy Act (CCPA/CPRA) in a court of competent jurisdiction. The arbitration clause does not apply to CCPA/CPRA claims.

EU / UK users: Nothing in these Terms limits or waives any rights you have under applicable EU or UK consumer protection laws, including the right to bring claims before your national courts or regulatory authorities.

Class Actions: To the maximum extent permitted by law, all claims must be brought in your individual capacity and not as a class member in any purported class or representative proceeding. If applicable law prohibits this waiver for your jurisdiction, it does not apply to you.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

13. Force Majeure

SpeaksyAI shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions, internet or telecommunications outages, third-party service failures (including Google Cloud Platform, Firebase, or Gemini API outages), strikes, or war. In such events, our obligations are suspended for the duration of the force majeure event.

These Terms & Conditions comply with Apple App Store Guidelines, Google Play Developer Program Policies, Indian Arbitration and Conciliation Act 1996, and applicable international consumer protection laws.
